Peter Obi files petition against Tinubu’s victory, seeks five prayers. He filed the petition at the Presidential Election Petition Court in Abuja, at about midnight on Tuesday.
The petition, jointly filed by Mr. Obi and the Labour Party as co-petitioners, joined the Independent National Electoral Commission (INEC), Mr Tinubu, Shettima Kashim (vice president-elect), and the All Progressives Congress (APC) as the respondents.
This was on the front page earlier but the actual items in the petition is not included so I am bringing the summary of the petition.
1. Tinubu/Shettima not qualified to contest
Mr Obi urged the Presidential Election Petition Court to “determine that at the time of the presidential election held on 25 February, 2023,” Messrs Tinubu and Shettima “were not qualified to contest the election.
2. All votes for the two should be voided
He prayed the tribunal “to determine that all the votes recorded for” Mr Tinubu “in the election are wasted votes, owing to the non-qualification” of the president-elect and Mr Shettima.
3. They didn’t score 25% in FCT
“That it be determined that the 2nd Respondent (Mr Tinubu) having failed to score one-quarter of the votes cast at the Presidential Election in the Federal Capital Territory, Abuja was not entitled to be declared and returned as the winner of the presidential election held on 25 February 2023.”
4. Order a Fresh election in which Tinubu/Shettima should be barred from participating
Mr. Obi prayed the tribunal to make “an order canceling the election and compelling the 1st respondent (INEC) to conduct a fresh election at which the 2nd Respondent (Tinubu), 3rd respondent (Shettima) and 4th respondent (APC) shall not participate.”
5. That The Presidential Election Was Not Free & Fair
That the Presidential election conducted on 25th February 2023 is void on the ground that the election was not conducted substantially in accordance with the provisions of the Electoral Act 2022 and Constitution of the Federal Republic of Nigeria 1999, as amended,
An order canceling the’ Presidential Election conducted on 25th February 2023 and mandating the (INEC) 1st Respondent to conduct a fresh election for the office of President, the Federal Republic of Nigeria.
